Terms and Conditions

This web-site is operated by Zapit Moments Limited (trading as "Zapit") which has its registered address at 3 Glenfinlas Street, Edinburgh EH3 6AQ and which is a limited company registered in Scotland, no. SC293272.

These terms and conditions govern the relationship between you and Zapit. Occasionally we may need to change or improve these terms and conditions so you should check them regularly to see if they have changed.

  1. The Zapit postcard service is only available to customers with mobile camera-phones which are MMS and data enabled and with UK network operators.
  2. If you are on a non-UK network at the time of use then roaming must be available to you under your contract with your UK network operator and you must have roaming enabled on your mobile phone. Your network operator will be able to help you set up your mobile phone correctly and to advise on where in the world roaming is possible. Zapit cannot be held responsible if your mobile phone is not correctly enabled for MMS, data or roaming or if you try to use the service from countries where MMS roaming is not available.
  3. Before you use the service you need to understand how to create and send MMS messages from your mobile phone. The instruction manual for your mobile phone or your network operator should be able to help you. Zapit cannot be responsible for showing you how to create and send MMS messages.
  4. It is your responsibility to ensure the correct recipient name and full postal address are typed correctly. Zapit cannot be held responsible for postcards which do not arrive due to names and addresses which are incorrect or invalid.
  5. Zapit will vet each MMS image and message to ensure they adhere to standard decency rules and laws in the countries that they are either sent from or to. Pornographic images or text that break the rules and laws of the countries that messages are sent from or to will not be delivered and may be passed to the appropriate policing authorities for investigation.
  6. Zapit cannot be held responsible for postcards which do not arrive due to Zapit deciding that they do not adhere to standard decency rules and laws in the countries that they are either sent from or to, or that the recipient considers to not adhere to standard decency rules and laws in the countries that they are either sent from or to.
  7. Zapit's decision is final in the vetting of images and text for decency and we reserve the right to charge you even if postcards are not sent or delivered.
  8. When you send images and messages to Zapit we will make them available on the web-site, provided they are not obscene or offensive. Access to view them on the web-site will be restricted to you and anyone to whom you give access.
  9. You must keep your password secure at all times. Zapit cannot be held responsible if you share your password with others.
  10. You will indemnify us and our officers and employees against any action, claim, damages, liability, costs and expenses, including legal fees, arising out of:
    • any use or misuse by you of the service provided by Zapit;
    • any claim that the images sent from your mobile phone by you or on your behalf is an infringement of any third party's copyright, trade mark or other intellectual property rights;
    • any claim that the processing, printing or other dealing with by Zapit in accordance with these terms of any images sent by you or on your behalf is an infringement of any third party's copyright, trade mark or other intellectual property rights.
  11. At Zapit we understand our customers concerns about privacy, after all we are all customers of other companies. The purpose of this policy statement on privacy is aimed at addressing these concerns. If there is anything that you are unsure about then write to me - theboss@zapit.co.uk.

What information do we collect ?

When you Zapit we collect the mobile phone number you used, we collect the picture, the message and the recipient for each MMS you send to us. In addition, if you log onto the web-site then we will store your IP address.

What do we do with all your personal data ?

We’ll keep it to ourselves and use it to run the service and to try and improve the service. This means that we may contact you by SMS to find out from you what you think of Zapit and how we might improve. We have lots of great ideas of other things we could do with Zapit and as we introduce them we may contact you to let you know about them.

If there were ever, and we think it highly unlikely, that there were to be a dispute about charging then we may need to share your data with the networks or our agents to resolve the dispute.

Who do we share your data with ?

Occasionally we may find a great service offered by a third party that we think would be a great product or service for Zapit customers. In such an instance we may pass on your contact details to the third party to allow them to contact you. If you don’t want us ever to pass on your details then tick the box on the registration page. If you change your mind then please let us know by writing to services@zapit.co.uk

If you use your credit card to purchase additional postcards or other gifts then we will pass your card details immediately to our payment service provider for immediate authorisation. We will not keep your credit card records on our database.

Of course if we receive a request to provide data where we have no option because of the law then we will do as we are told.

How secure is the data we hold ?

All our data is held on a secure server with back-up and can only be accessed by us or you. Of course, that means that if you have registered to use the photo album page then you need to keep your password safe. We cannot be held responsible if you give your password to someone else and they then abuse your privacy.

How long do you hold the data for ?

If you register for the album service then we will hold your data for at least six years and longer if you still want us to. If you don’t register then we will remove your pictures after six months but we will keep your contact details. If, for some unimaginable reason, you want to stop being a customer then let us know and we will destroy all the data we hold about you.
